Supreme Court Refuses New Guidelines for Doctors’ Safety, Says It’s a Matter for Parliament

The Supreme Court of India has refused to issue any new guidelines to protect doctors against the rising incidents of violence and assault.
The court made it clear that it cannot monitor every incident and emphasized that it is the Parliament’s responsibility to make new laws if needed.

The case was heard by a bench comprising Justice Bela M Trivedi and Justice Prasanna B Varale, who observed that guidelines for the protection of doctors already exist.
They suggested that if doctors still face issues, the High Courts are the proper forum to approach for relief.

Three petitions were filed in 2022 by:

  • Delhi Doctors Forum
  • Indian Medical Association (Dwarka)
  • Advocate Suneet Kumar Upadhyay

They raised concerns about:

  • Increasing assaults on doctors across India.
  • A request for a CBI probe into the suicide of Dr. Archana Sharma, a gynecologist in Rajasthan, who died after being harassed following a patient’s death.
  • Seeking better protection laws and compensation mechanisms for doctors and their families.

  • General monitoring by the Supreme Court is not possible for every incident.

  • Petitioners were given the freedom to approach the High Courts for specific issues.
