In a major move to reduce legal burden and improve compliance, the Ministry of Health and Family Welfare has introduced the Drugs and Cosmetics (Compounding of Offences) Rules, 2025.
This means that individuals or companies involved in the manufacturing, import, sale, or distribution of drugs, cosmetics, or medical devices can now settle certain minor offences without going through a full criminal trial.
The rules were officially notified in the Gazette of India on April 24, 2025.
đź§ľ What is “Compounding of Offences”?
Compounding means settling a legal offence by paying a fine without going to trial.
This new rule helps:
- Pharmaceutical companies
- Medical device manufacturers
- Cosmetic businesses
settle minor violations of the Drugs and Cosmetics Act, 1940, in a simpler and faster way.
⚖️ Who Can Apply?
Any person or company involved in the drug or cosmetic industry can apply for compounding:
- Before or after legal prosecution starts
- By applying with the required documents to the designated compounding authority
🏛️ Who Are the Compounding Authorities?
The Central and State Governments will appoint officers to handle these cases:
- Officers not below the rank of licensing authority will be chosen.
- They will decide whether to approve or reject compounding applications.

- The company or person submits a compounding application.
- The authority reviews the case and seeks a report from the licensing department.
- The application is approved or rejected after hearing the applicant.
- If approved, a compounding amount (fine) is decided.
- The applicant must pay within 30 days and submit proof.
Once paid, the applicant receives immunity from prosecution.
⚠️ When Can Immunity Be Withdrawn?
Immunity from prosecution can be taken back if:
- The compounding amount is not paid on time
- The applicant conceals facts or gives false evidence
If this happens, criminal proceedings may resume as if no immunity was ever granted.
